TRID Safely In a Flood of Disclosures: This is the mandatory core course that, with minor exception, must be taken by every licensee prior to 2017 or 2018 renewal. It covers three major topics: TRID, the Residential Property Condition Disclosure Form, and Flood Insurance.

South Carolina Contracts
1:30pm-5:30pm
4 Hours Continuing Education Elective Credit

SC Real Estate Contracts starts with the basis of contract law, including the requirements of consideration, competency of the parties, as well as acceptance and delivery. A review of SCR contracts is included, covering the exclusive agency and exclusive right to sell listing agreements, the exclusive agency and exclusive right to represent buyer agency agreements, and the contract for sale forms 300 and 310. A special emphasis is placed on the due diligence addendum, the termination of the contract form, and the multiple offer form.

Stories of the Code

4 Hours Continuing Education Elective Credit/2.5 Hours NAR Code of Ethics

This course focuses on the case interpretations of the Code of Ethics and will bring the Code to life with real-world scenarios. In addition to giving four hours of elective credit, this course also meets the NAR mandate of 2.5 hours quadrennial ethics training.

Multiple Offers Q and A

4 Hours Continuing Education Elective Credit

There is no other issue in real estate that adds more frustration to negotiations that being in a multiple offer situation. When communication breaks down, each party may begin to jump to conclusions that innuendoes begin to fly. This class is a review of NAR’s take on multiple offer situations and involves the determination of “best practices” when involved in a multiple offer situation.

BIC Duties and Responsibilities

4 Hours Continuing Education Elective Credit

This is the mandatory course that is required of all BIC who are renewing after June 30, 2017. It covers the duties and responsibilities of the BIC, works through trust account issues, and assists the BIC in determining the components of the office policy. Four hours elective credit.

Appraisal Roundtable on May 31st

You are invited to attend our first annual Appraiser Roundtable at the Association Office on May 31 from 10-12. The purpose of the roundtable is to allow you to ask questions, express concerns, and to create a dialogue with our local appraisers in an informal, helpful setting. Co-sponsored by Upstate Professional Appraisers Coalition, the goal of the meeting is to keep the lines of communication open while working cooperatively to meet buyer, seller, and lender goals.

Feel Like Complaining?

We all have complaints from time to time and need an avenue to vent and express our frustrations.

When you have a complaint, whether regarding staff, procedures, or the behavior of other members, talk to your President/CEO Peggy about the issue. You will be able to speak to her in the strictest of confidence. And she will be able to follow up with you regarding the action taken to resolve your complaint.

Remember that you are our customer, that our job is to serve you and to provide the products and services you need. We always want to hear from you—whether it’s a complaint or a compliment!


ATTENTION BIC’s

This is a reminder that the Bylaws of the Association require that the BIC assures that every associated licensee is both a member of the Association and our MLS.

It has been brought to our attention that this is not being handled in a timely manner and that there are licensed associates working in brokerages that are not members of the Association and MLS.

The Association Bylaws state:

The annual dues of each Designated REALTOR® shall be (determined each year) plus and additional amount to be established annually by the Board of Directors times the number of real estate salespersons and licensed or certified appraisers who are employed by or affiliated as independent contractors, or who are otherwise directly or indirectly licensed with such REALTOR® Member

We routinely crosscheck our member records with the records of LLR and often find omissions. Remember that it is the duty of the BIC to comply with this rule and failure to do so can result in fines and other sanctions. Each BIC can determine associated licensees by following the link to “licensee lookup” at www.llronline.com/pol/rec.

April Market Reports are Out

The employment landscape and wages have both improved over the last few years, allowing for more people to participate in the home-buying process. When the economy is in good working order, as it is now, it creates opportunities in residential real estate, and right now is a potentially lucrative time to sell a home. Houses that show well and are priced correctly have been selling quickly, often at higher prices than asking.

'Coming Soon' Properties

I have been receiving many calls concerning “coming soon” ads in email and on social media.

Don’t be too quick to begin marketing a property when you have no listing agreement in place. The issue of “coming soon” signs has already been addressed by the Real Estate Commission Advice Counsel and compliance with the law is mandatory.

License Law states: A licensee may not advertise, market, or offer to conduct a real estate transaction involving real estate owned in whole or in part by another person without first obtaining a written listing agreement from the owner.

A licensee may legitimately withhold a property from MLS if the seller authorizes that action in the listing agreement. Without a listing agreement, however, the property cannot be marketed by a licensee in any method—signs, emails, on social media, flyers, or even trying to sell it on the basis of a verbal “agreement” with the seller.

Do You Have a Georgia license? If so, Review the Renewal Requirements for Non-Residents Beloww

A non-resident licensee who holds an active real estate license in another state, may provide proof of meeting the education requirements in that state to satisfy the Georgia requirements by:

(a)Submitting a copy of your current pocket card from the other state. That pocket card must state the license is in Active status, as well as indicate a renewal date greater than the due date for your Georgia renewal. (For example, if your Georgia renewal due date is May 31st of this year, then your pocket card in the other state must have an end of renewal due date of June 1 of this year or later.)

-OR-

(b) Submitting course completion certificates showing completion of at least 36 hours of continuing education that was approved by the other state's real estate commission. In order to expedite processing, it is recommended that information submitted to GREC by sent via email to GRECmail@grec.state.ga.us. Documents may also be sent via fax to 404-656-6650 or by mail, or in person.
